1. Agreement to Terms

By accessing or using Naturopathy NZ's website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Naturopathy NZ.

2. Services Description

Naturopathy NZ provides:

• Naturopathic Consultations: One-on-one video consultations with qualified naturopaths (Initial: $180 + GST per hour, Follow-up: $90 + GST for 30 minutes)
• Health Products: Sale of nutritional supplements and health products
• Health Information: Educational content about natural health and wellness

Important: Our services are exclusively for women and focus on female-specific health concerns.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be female (for consultation services)
• Have legal capacity to enter into a binding contract
• Provide accurate and complete information
• Comply with all applicable laws in New Zealand

4. Consultation Services

4.1 Booking Process

• Contact us via email or phone to request a consultation booking
• Provide information about your health concerns and availability
• Payment will be arranged before your scheduled consultation
• You will receive a video call link for your appointment
• Initial consultations are charged at $180 + GST per hour
• Follow-up consultations are charged at $90 + GST for 30 minutes

4.2 Practitioner Review

We reserve the right to decline consultation bookings if we determine we are not the appropriate service provider for your needs. Reasons for declining may include:

• Requirements for emergency medical care
• Active psychiatric care needs
• Substance abuse issues requiring specialized treatment
• Unrealistic expectations for natural health approaches
• Lack of commitment to recommended lifestyle changes

4.3 Consultation Delivery

• Consultations are conducted via secure video call
• Duration: 45 minutes
• You will receive a video call link via email 24 hours before your appointment
• A stable internet connection and camera/microphone are required

4.4 Cancellation & Rescheduling

• More than 48 hours notice: Free reschedule or full refund
• 24-48 hours notice: One free reschedule, no refund
• Less than 24 hours notice: No reschedule or refund
• No-show: Forfeiture of consultation fee

5. Medical Disclaimer

IMPORTANT: READ CAREFULLY

• Naturopathy is a complementary health service, NOT a replacement for medical care
• We do not diagnose, treat, cure, or prevent any disease
• Our practitioners are not medical doctors
• Information provided is for educational purposes only
• Always consult your GP before making health changes, especially if you have medical conditions or take medications
• Do NOT stop prescription medications without medical supervision
• Seek immediate medical attention for emergencies

By using our Services, you acknowledge that you understand these limitations and will seek appropriate medical care when needed.

6. Product Sales

6.1 Product Information

We strive to provide accurate product descriptions, but we do not warrant that product descriptions, images, or other content are complete, reliable, or error-free.

6.2 Pricing

• All prices are in New Zealand Dollars (NZD)
• Prices include GST where applicable
• We reserve the right to change prices at any time
• The price at the time of purchase applies to your order

6.3 Payment

• Payment is processed securely through Stripe
• We accept major credit and debit cards
• Payment must be received before products are shipped

6.4 Shipping

• We ship within New Zealand only
• Shipping costs are calculated at checkout
• Delivery timeframes: 3-7 business days (estimate only)
• Risk of loss passes to you upon delivery to the carrier

7. Refund Policy (Consumer Guarantees Act 1993)

7.1 Consultation Refunds

• Full refund if not approved by practitioner during review
• Full refund if cancelled more than 48 hours before appointment
• No refund for late cancellations or no-shows
• No refund after consultation has been delivered

7.2 Product Refunds

Under the Consumer Guarantees Act 1993, you are entitled to a refund or replacement if products:

• Are faulty or not of acceptable quality
• Do not match the description provided
• Are not fit for purpose

For non-faulty returns:

• Must be unopened and in original condition
• Must be returned within 14 days of delivery
• Shipping costs are non-refundable
• Customer pays return shipping unless product is faulty

7.3 Refund Processing

• Approved refunds processed within 5-10 business days
• Refunds issued to original payment method

8. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current information

9. Prohibited Uses

You may not use our Services to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code or malware
• Harass, abuse, or harm others
• Impersonate others or provide false information
• Use automated systems (bots, scrapers, etc.) without permission
• Resell or commercialize our Services without authorization

10. Intellectual Property

All content on our website (text, images, logos, designs, etc.) is owned by Naturopathy NZ or our licensors and protected by New Zealand and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works without our express written permission.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY NEW ZEALAND LAW:

• We provide Services "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service or product
• We are not liable for health outcomes, treatment results, or supplement effectiveness
• We are not responsible for decisions you make based on our advice

Note: Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Consumer Guarantees Act 1993.

12. Indemnification

You agree to indemnify and hold harmless Naturopathy NZ, its practitioners, and affiliates from any claims, damages, or expenses arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your provision of inaccurate information

13. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior toward staff or practitioners
• Non-payment

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

Relevant legislation includes:

• Consumer Guarantees Act 1993
• Fair Trading Act 1986
• Privacy Act 2020
• Contract and Commercial Law Act 2017

15. Changes to Terms

We may update these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services after changes constitutes acceptance of the new Terms.

We will notify you of material changes by email or prominent website notice.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Naturopathy NZ regarding the use of our Services.
